Under HIPAA, 42 CFR Part 2, FERPA, and 38 U.S. Code § 7332, there are numerous privacy laws and regulations issues that may impact the delivery of educational content, at a distance, across a wide variety of disciplines. Topics to be addressed, among others, include: 1) Is your approach to texting compliant?; 2) Are your phone conversations safe and encrypted?; 3) Is your videoconferencing system safeguarded?; 4) How are you using social media?; 5) How do you protect your documentation from unauthorized access?; and 6) What information can you reveal (and to whom), and what is privileged?; 7) What policies should be in place to protect you, your employer, and your students?
